   2.  Public Hearing of Ryan Mumm's Request for Setback Variance to Reduce His East Side Yard Building
        Setback line from ten feet (10) to eight feet (8)

VILLAGE OF SIDNEY BOARD OF TRUSTEES MEETING  November 7, 2016

    The Sidney Village Board met on the above date for the regular monthly meeting.  President White called the meeting to order at 7:00 p.m. with the Pledge of Allegiance.   The following trustees were present:  Arrasmith, McCloud, Finn, Roberts, and Schluter.  Village Clerk Moore,  Supervisor of Operations Bennett, Treasurer Reinhart, and Attorney Hendren  were also present.  Trustee Cokley was absent.
    Trustee Schluter moved that the minutes of the October 3,  2016, Board of Trustees regular meeting be approved.   Trustee Finn seconded the motion.  The motion carried with all ayes on a roll call vote.
    
    PUBLIC COMMENTS:

    A resident expressed concerns about public safety on S. David Street and also on Prairie.  The speed limits and stop signs are not being observed, and all kinds of vehicles like ATVs and golf carts are being driven on the streets, often with children or underage drivers.  He asked what was legal.  None of it is.  He was told he had to call the County Sheriff and report it.  He said he had done that and if and when they came, the offender was gone.  The Trustees sympathized with him but had no solution besides calling the Sheriff.
    
    PRESIDENT WHITE'S COMMENTS

    President White reported that the sewer system loan was paid and he had the canceled loan with him to be filed.  The amount of the loan was $800.000.
    Letters were sent to seven people who had expressed interest in serving on a zoning board.  Three had responded.
    There will be no caucus of the Peoples Party this year, and everyone will run as an independent.  The election for municipalities will be  April 4, 2017.  For Sidney the offices of President, three 4-year Trustee terms, and one 2-year Trustee term will be up for election.  The first day to circulate petitions is September 20 to be handed in between December 12-19, 2016.  Clerk Moore is the Local Election Official and has the forms to file for election.  Three people picked up forms.
    It is time to pay insurance again and the Board agreed to pay the whole bill by November 20 in order to receive the discount.

    ATTORNEY HENDREN'S COMMENTS:

    Trustee Finn moved the the Board of Trustees postpone voting on the rezoning of the seven school lots and look into the special use zoning.  Trustee McCloud seconded the motion; the motion carried with all ayes on a roll call vote.  Attorney Hendren will draw up another ordinance for special use zoning.
    Attorney Hendren presented the ordinance for a variation in zoningon Ryan Mumm's property.  He pointed out that on page 5 , Findings of Fact, reasons for the variation, can be added to.  Trustee Schluter moved that the Village approve Ordinance No. 2016-06, an Ordinance Granting a Building Set Back Variance for 208 Wilsey Lane, Sidney, Illinois.  Trustee Finn seconded the motion; the motion carried with all ayes on a roll call vote.
    Attorney Hendren said that he had heard nothing from the Sidney Township about the draft of a possible intergovernmental agreement between the Village of Sidney and Sidney Township. Sidney Township Supervisor Tim Osterbur was present and said the Township Board meeting is Wednesday and he will be presenting it to them then for their input.
    The tax levy ordinance has to be adopted next month.  The maximum increase that the Village can have is $450.  The Board asked that that amount be added to the water levy.

    EARL BENNETT'S REPORT

    The culvert project on North Scarborough started today and should be finished Wednesday.
    The Kubota is in and is being used.

    FINANCE REPORT

    The financial reports were read by Trustee McCloud.  Trustee McCloud moved that the bills be paid with the addition of $17,525.97 to Illinois Municipal League Risk Management for insurance.  Whitsitt and Associates are also to be paid, but that had already been approved.  Trustee Finn seconded the motion.  The motion carried with all ayes on a roll call vote.
    
     STREETS AND ALLEY

    No report except for the Scarborough project that Supervisor Bennett reported on
    
    WATER/SEWER/UTILITY

    2,674,747 gallons of water were pumped in October with a daily average of 85,712 gallons.  
    $34,757.49 was received in October with $9,837.25 in sewer planning money. 132 penalty bills were sent.  
    
     PUBLIC PROPERTY

    One building permit was issued in October:  $50, 212 West Byron, fence, permit #693.
    The roof of the Community Building had been patched and the bill paid.  G&E Services had submitted the low bid of $6,850 to remediate the mold in the Community Building.  Trustee Arrasmith had checked what each of the two bidders would do and if G&E had all the certifications and insurance.  He was satisfied that they did.  (The other bid was for $17,620, quite a bit higher.) Trustee Finn moved that the Village accept the bid of G&E Services of $6,850.  Trustee Arrasmith seconded the motion; the motion carried with all ayes on a roll call vote.
    Whitsitt and Associates had appraised the school lots for $102,000.
    The sirens of ESDA are all up and running.
    
    PARKS AND RECREATION

    The benches are in and Tyler will be installing them.  He is working on certification for a food service handler for the ball park concession stand.

    COMMUNITY DEVELOPMENT

    Nothing to report.
    
    Trustee McCloud moved that the meeting be adjourned.  Trustee Finn seconded the motion; motion carried with all ayes on a roll call vote. Meeting was adjourned at 8:40 PM.

VILLAGE OF SIDNEY BOARD OF TRUSTEES SPECIAL MEETING November 7th, 2016

            The Sidney Village Board met on the above date for a Public Hearing of Village of Sidney's Request for Rezoning of Lots 5, 6, 7, 13, 14, 15, and 16 of Joseph Thomas's Addition to the Village of Sidney, Illinois, from R-1 Single- and Two-Family Residential District to C-Community Business District.  Trustee Arrasmith, in President White's absence, called the meeting to order at 6:00 p.m.   The following trustees were present:  Arrasmith, McCloud, Roberts, Finn, and Schluter.  Village Clerk Moore, Attorney Hendren, and Supervisor of Operations Bennett were also present.  President White and Trustees Cokley were absent. 
            First, Trustees presented a bit of history about the proposal.  Once a school is no longer there, the property reverts back to R-1.  The Sidney Township building had mold, discovered when the bathrooms were being refurbished.  A public meeting was held, very well attended, and two options were offered:  mold remediation or a new building. All but one person voted in favor of a new building.  Right now the Township has no building, and that is why Sidney residents are voting at the Sidney United Church tomorrow.  The Township approached the Village to see if a joint building was feasible.  The Village's present Community Building is in bad shape and needs a lot of work. 
            After that, Trustee Arrasmith opened the hearing up for public comment.
            Question:  Will the whole property be rezoned?  Answer:  Yes
            Question:  What happens if the two units decide not to build a building there; can commercial groups come in?  Answer:  Will not happen.  Both Boards plan to go forward with the building.
            Question:  Will the Township build anyway even if the Village does not join in? Answer:  Yes.  The Township has been looking at two-three properties.  Nothing else is for sale.  If Village does not join in, Township will probably build an addition on the maintenance building and it will not be a multi-use building.
            Question:  Can you afford it?  Answer:  The Township has the money; the Village will borrow.  The Village owns the lots to be rezoned so will not have to put out money for other property. 
            Question:  Do you know what is buried there?  Answer:  Yes
            Question:  Could the ordinance be written so that the property would revert back to R-1 if the building is not built?  Answer:  Attorney Hendren:  Can have a special use rezoning
            Question:  Has the Village thought of building to the west of town because if the town grows, that would be the direction of the growth?  Answer:  The town will not grow without a sewer system, and that would be many years away. 
            Question:  How big is the building?  Answer:  7,000 square feet, 70 x 100
            Question:  How about the parking and the lights?  Answer:  The building will be on the north end of the property in the middle with parking in front and behind, probably about ninety spots.  Access will be off Washington.  We will be considerate in the lighting. 
            Question:  The Sidney Christian Church is concerned about what activities will be held there and how it will affect them and their activities. The Church Board had sent a letter with some concerns. Discussion was held about what kind of activities could take place and what did take place in the old Town Hall.
            Question:  Does it have to be voted on tonight?  Answer:  No
            It was generally agreed that the special use zoning would allay most fears.  Residents would like to see  more specific plans for the building also.
            Trustee McCloud moved that the first special meeting be closed.  Trustee Roberts seconded the motion; the motion carried with all ayes on a roll call vote.  The first hearing was  adjourned at 6:45 PM.
 
            Trustee McCloud moved that the second hearing be opened, a Public Hearing of Ryan Mumm's Request for Setback Variance to Reduce His East Side Yard Building Setback Line from ten feet (10) to eight feet (8).  Trustee Roberts seconded the motion; the motion carried with all ayes on a roll call vote.
            Tyler Bickers, Ryan Mumm's neighbor to the east, said that it was okay with him to grant the variance. No one else spoke.  Trustee Arrasmith moved that the second public hearing be closed.  Trustee McCloud seconded the motion; the motion carried with all ayes on a roll call vote.  The hearing was adjourned at 6:52 PM.
